Terms & Conditions
The
following terms and conditions apply to all transactions on Bernies Bobbins.com.au
(the “Website”) and your use of the Website itself.
Bernies
Bobbins.com.au is the website for Bernies Bobbins Pty Ltd, being the trading
name of a company based in Western Australia, Australia. You, the customer, and
we, Bernies Bobbins Pty Ltd, agree to submit to the exclusive jurisdiction of
the courts located within Western Australia, Australia shall any such dispute
arise.
Ordering
When
you place an order, we will treat it as an offer to buy. A confirmation email
of your offer to buy will be sent notifying you we have received your order. Once
we accept your order, we will send you a confirmation email containing your
order number, at which point we have entered into a legal binding contract with
you. Should Bernies Bobbins Pty Ltd decide not to accept your order, we will
notify you via email.
In
deciding to accept your order, we may use the information provided by you, or
the information we may already hold on you, or information we receive from
enquiry’s we make externally to confirm your identity.
This
assists us to protect both you, the customer, us, Bernies Bobbins Pty Ltd, from
fraudulent transactions. Should we decline your offer to buy on security
grounds, we may contact you to seek alternative payment method.
Stock
Everything
advertised on our website is in stock at our Western Australia Office. In the
instance we run out of stock, we will advise you, the customer, of a possible
alternative product or, alternatively, we will confirm if there will be any
additional delays’ in processing your order.
Payments
Our
secure buying system is authorised via PayPal, VISA or MasterCard. Choose your
product and click the “add to cart” button. You will be taken to the payment
page. We use the PayPal system which takes payment directly from your bank a/c
via your card details. You do not have to have a PayPal account to make a
transaction.
All
prices are in Australian dollar and are inclusive of GST.
Postage
Postage is included in the final price. Postage
is calculated on weight and size basis.
Shipping
Where
free delivery is applicable, goods will be posted using economy/budget methods. Bernies Bobbins Pty Ltd will not
be held liable for any loss or damage resulting from late delivery. You
acknowledge and agree that late delivery does not constitute a breach by us of
our agreement and does not entitle you to cancel an order. Bernies Bobbins Pty
Ltd is an Australian Based company, and will only post inside Australia.
-It is sometimes possible to leave a contact number with us and we will
pass it on to the driver who can contact you to ensure safe delivery of your
parcel.
Problems
In
the event that any items are lost or damaged during transit, please submit a
support ticket via our contact page.

Your item will be dispatched to the address used at check out.

We are not responsible for items sent to an incorrectly supplied address.

We are not responsible for items you forget to collect in time. Item(s) returned
to us will incur an additional fee for re posting. We will not accept
liability for any loss or damage arising from items lost, stolen or damaged
after delivery has taken place.
Returns
We
can only accept items returned to us within reasonable time (30 days) from the
date your order was purchased. All items must be returned to us before a refund
or replacement is issued. Please thoroughly inspect any item you order from us
on receipt as we will only accept products returned to us in their original
condition and fit for re-sale unless we have been given prior notice that an
item is faulty. Delivery charges are non-refundable unless the item purchased
is faulty or incorrect.
(A
polite request, please fold returned items neatly before sending them back to
us.)
For
return to sender (RTS) or delivery refused, there will be 15% restocking fee
from the subtotal. Shipping costs are not refundable.
To
ensure no loss or damage in the mail, all returns must be sent registered with
tracking and tracking code must be quoted via email.

For return to sender (RTS), wrong/partial address supplied or delivery refused
returns, there will be 15% restocking fee from the subtotal. Shipping costs are
not refundable.
For wrong choice, changed mind or otherwise, there will be 50% restocking fee
from the subtotal. Shipping costs are not refundable.
All
postage is non-refundable.
Faults
If
the item you received is faulty, please accept our sincere apologies for the
inconvenience. Please submit a support ticket via our contact page. We
will then advise on how to proceed. You have 7 days from receipt of the faulty
item to return it to us.
Errors
If
the item you received is not what you originally ordered, please accept our
sincere apologies for the inconvenience. Please submit a support ticket via our
contact page. We will then advise on how to proceed. You have 7 days from
receipt of the incorrect item to return it to us.
Distance Selling Regulations
Under
the Australia’s Distance Selling Regulations you have the right to cancel your
order for any item purchased from Bernies Bobbins for a limited refund. This
does not apply to items that cannot be returned for hygiene reasons or have
been unsealed. Order cancellations must be made in writing, quoting your name,
address and order number, within 7 days of delivery of your item(s) by post to
the address above. Once you have cancelled your order, the goods should be
returned to the same address, in their original condition, within 7 days of
receipt. The item is your responsibility until it reaches us. For your own
protection, we recommend that you send the parcel using a delivery service that
insures you for the value of the goods.
Information of the Goods

The description of the goods as depicted on the
website are issued for the sole purpose of giving an approximate idea of the
goods described in them. Bernies Bobbins.com.au will not accept any
responsibility for any variation in shade, material or composition shown within
our website.
2. You, the customer,
has not, in acquiring the goods, relied upon the skill, judgement or
recommendation of Bernies Bobbins Pty Ltd or any of its employees or agents.

Whereas every attempt has been made to supply an
accurate image of the items on Bernies Bobbins.com.au, Website colours should
be used as a guide only.
Fraud, High Risk or other customers
We
reserve the right to refuse orders not originating from Australia or Australian
credit card holders due to high fraud risk. Bernies Bobbins does not ship
internationally.
Intellectual Property Rights
The
rights in the designs and the content of this Website are owned by Bernies Bobbins.com.au.
They are protected by copyright and other intellectual property rights. You may
not copy, reproduce, modify, distribute or display any part of this site
without permission. All commercial product licenses and rights are owned by Bernies
Bobbins.com.au.
Warranty
Guidelines
Bernies Bobbins hereby warrants to the purchaser that all items are serviceable
and functional. If an item is found to be defective within 30 days from date of
invoice, Bernies Bobbins shall at its discretion, provide either a replacement
or a refund. Items not defective, which are returned for any reason, (e.g. incorrectly
ordered, changed mind, buyers’ remorse) are subject to a 50% restocking charge.
All returned items MUST be accompanied by a sales receipt or invoice number. No
refund will be given after 30 days. The warranty will be void if items are not
returned in the same condition they are sold. We shall not be responsible for
any items which have been altered, modified, disassembled or damaged by misuse
or accident subsequent to purchase. Bernies Bobbins is not responsible for
buyer’s error. No warranty or reimbursements will be given for delay, labour,
mileage, or any other such costs.

Right to alter Terms & Conditions
We
reserve the right to alter these terms and conditions without notice from time
to time. The responsibility is on the customer to read these terms and
conditions when accessing the site.
